Terms of sale

These terms of sale apply to every order placed on lovaeapp.com and to every Premium subscription taken out from the Lovae app. They complement the terms of use, which govern the use of the Service.
1. Seller identity
The seller is SDT, a French single-shareholder simplified joint-stock company (SASU) with a share capital of €100, registered with the Toulouse trade and companies register under number 999 633 100, with its registered office at 4 impasse Gabriel Laurens, 31110 Bagnères-de-Luchon, France. Intra-EU VAT number: FR73 999633100. President: Théa Saint-Denis.
2. Products and services sold
Lovae is a mobile app and a website for cycle tracking and wellness. Two offers are for sale: the Premium subscription, which unlocks all the features of the app for the whole subscribed period, and the digital book, sold as a single PDF purchase and downloadable after payment. Part of the app remains free and requires no purchase. Lovae is a wellness tool: it is not a medical device and does not replace the advice of a healthcare professional.
3. Prices
Prices are shown in euros, all taxes included. The Premium subscription is offered at €49.99 per year or €12.99 per month. The digital book is sold at €24.99. The applicable price is the one displayed at the time of the order. Prices may change at any time, with no effect on ongoing subscriptions before their next renewal, and any change is announced to you before it applies.
4. Payment
Payment is taken by the store or provider you subscribe through: Apple's App Store for a subscription started from the iPhone app, Google Play for a subscription started from the Android app, and Stripe for a subscription or a book bought on lovaeapp.com. We never see nor store your card details: they are handled directly by those providers, on their own payment pages. The order is final once payment is confirmed, and the purchase summary is provided to you by the relevant provider.
5. Term, automatic renewal and cancellation
The Premium subscription runs for an indefinite term and renews automatically at the end of each period, monthly or yearly, at the price then in force, until it is cancelled. Cancellation always happens with the store that takes the payment: in the subscription settings of your Apple account for an iPhone subscription, in the Subscriptions section of Google Play for an Android subscription, and from the "My account" page of this site (Stripe portal) for a subscription bought on lovaeapp.com. It must be done at least 24 hours before the end of the current period. Cancellation takes effect at the end of the period already paid for: you keep access until that date, and the period already started is not refunded.
6. Free trial
A free trial may be offered before the first payment. Its duration and the date of the first charge are shown to you before you confirm the order. The trial is limited to one per person. If you do not cancel before it ends, the subscription is charged automatically at the announced price: a forgotten trial does not give a right to a refund.
7. Right of withdrawal
For a purchase made on lovaeapp.com, you have in principle fourteen days from the conclusion of the contract to withdraw, without having to give a reason (Article L221-18 of the French Consumer Code). As both the Premium subscription and the digital book are supplied immediately, you expressly request their immediate performance and expressly waive your right of withdrawal when you order: that request and that waiver are collected through a checkbox on the payment page, before any charge. Under Article L221-28 of the French Consumer Code, the right of withdrawal can no longer be exercised once the digital content has been supplied or the service fully performed with your agreement. Subscriptions bought from the App Store or Google Play are governed by Apple's or Google's own terms of sale, to whom any refund request must be addressed.
8. Customer service and complaints
For any question or complaint about an order, write to us at contact@lovaeapp.com. We reply to the address used for your order. Please include the purchase date and the email address used, so that we can find your order.
9. Consumer mediation
Under Article L612-1 of the French Consumer Code, you have the right to use a consumer mediator free of charge to settle a dispute with us amicably, after first trying to resolve it directly with us through a written complaint.
The details of the competent mediator will be published here as soon as we join a mediation scheme. In the meantime, send us your complaint by email: we undertake to answer it.
10. Governing law and jurisdiction
These terms of sale are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing agreement, the French courts have jurisdiction. If you are a consumer, you may choose to bring the case before the court of the place where you lived when the contract was concluded, the court of the place where the harmful event occurred, or the court of SDT's registered office.
